These Terms & Conditions explain the general terms that apply when you use angelorellanaa.com, contact me about a project or engage my professional digital services.

Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of angelorellanaa.com (the “Website”) and provide general terms relating to professional digital services offered by Angel Orellana (“I,” “me,” or “my”).

By using this Website, submitting a project inquiry, or engaging my services, you acknowledge these Terms. Additional proposals, agreements, contracts, invoices, statements of work, or other project-specific documents may apply to services you purchase.

Where a project-specific written agreement establishes terms that differ from these general Terms, the project-specific agreement will govern with respect to that project to the extent of the inconsistency.

Services

Services may include Professional Websites, E-Commerce websites, digital strategy, website content development, visual content development, Meta Ads, Google Ads, and other related digital services agreed upon for a specific project.

The exact scope, deliverables, pricing, timeline, responsibilities, and other requirements for a project may be established through the Website, a proposal, contract, invoice, written communication, or another applicable project document.

Not every service or feature displayed on the Website will necessarily be appropriate or available for every project.

Website Projects

New website projects are built from the ground up using the platform and workflow I use for website development.

I do not generally take websites created in WordPress, custom-coded environments, or other third-party platforms for modification, repair, restructuring, or redesign within their existing environment.

If you already have a website, it may be reviewed as a business reference to better understand your services, products, branding, content, or existing digital presence. When appropriate, an existing domain owned by the client may be connected or used with a newly developed website project.

Access to, transfer of, or use of a domain is subject to the requirements and policies of the applicable domain registrar or service provider.

Professional Website Services

Professional Website projects begin with a base structure and price as presented on the Website at the time of inquiry or proposal. The starting package may include a defined number of informational pages, service or product pages, custom content, visual content, responsive adaptation, customer journey planning, and launch preparation.

Requests that exceed the included scope may result in additional fees or require a separate proposal.

Professional Website projects may be offered under a Website Managed option or a Full Ownership option, depending on the arrangement selected for the project.

Website Managed

Under the Website Managed option, I maintain management of the website infrastructure and applicable recurring services included in the arrangement.

Annual renewal fees may apply and may include services such as hosting, domain, SSL, and professional email according to the package or agreement in effect.

Renewal pricing, included services, and applicable terms may change over time. Current renewal terms will apply when renewal is due unless otherwise established in a written agreement.

Failure to complete an applicable renewal may result in the expiration, suspension, or interruption of services associated with the website.

Full Ownership

When Full Ownership is included or purchased for a website project, control of the completed website and responsibility for applicable recurring services may be transferred to or managed directly by the client according to the project arrangement.

After transfer, the client is responsible for recurring costs, account management, renewals, platform requirements, and other services that are no longer included under my management unless a separate ongoing service has been agreed upon.

Third-party platform, hosting, domain, email, application, or service fees remain subject to the pricing and policies of their respective providers.

E-Commerce Projects

E-Commerce projects may include informational pages, store structure, product pages, product categories, offers, product imagery, content, responsive adaptation, and other elements defined within the applicable package or project agreement.

The number of pages, products, categories, offers, images, and other deliverables included depends on the scope purchased.

Requests beyond the included structure may require additional fees or a separate proposal.

Unless otherwise stated in a project-specific agreement, Full Ownership is included with E-Commerce projects offered through the Website.

Additional Services and Scope Changes

Additional pages, products, visual content, videos, campaigns, or other work beyond the agreed scope may be subject to additional charges.

Published prices identified as “starting at,” base prices, or add-on prices represent the applicable starting point or defined additional service and do not guarantee that every project can be completed for that amount.

Projects with broader requirements, greater complexity, additional campaigns, expanded functionality, or other needs outside the base scope may be evaluated individually and quoted separately before the additional work is performed.

Digital Growth and Advertising Services

Digital Growth services may include Meta Ads, Google Ads, or a combination of both.

Service fees cover the professional work and scope described in the applicable service package or agreement. Advertising budgets are separate from professional service fees unless expressly stated otherwise.

Clients are responsible for the advertising budget paid to Meta, Google, or another applicable advertising platform.

Advertising services may include strategy, research, campaign setup, advertising content, campaign management, monitoring, evaluation, and optimization according to the purchased scope.

Additional campaigns, expanded advertising structures, additional creative production, or requirements beyond the base service may require a separate evaluation and proposal.

Advertising Results

Advertising performance can be influenced by many factors outside my control, including market conditions, competition, geographic area, customer demand, advertising budget, offer quality, pricing, seasonality, platform algorithms, account history, website experience, and changes made by advertising platforms.

For this reason, no specific number of leads, sales, customers, conversions, revenue, return on advertising spend, ranking, or other business result is guaranteed unless expressly stated in a separate written agreement.

Campaign management and optimization are intended to improve decision-making and campaign execution over time but do not guarantee a particular commercial outcome.

Third-Party Platforms and Services

Projects may depend on third-party services such as Hostinger, domain registrars, email providers, Meta, Google, WhatsApp, payment providers, analytics platforms, or other external technologies.

These services operate under their own terms, policies, pricing, technical requirements, availability, and business decisions.

I am not responsible for outages, account suspensions, platform policy changes, pricing changes, service discontinuations, algorithm changes, technical failures, or other actions controlled by third-party providers.

Where a client directly owns or controls a third-party account, the client remains responsible for complying with that provider’s terms and maintaining the account in good standing.

Client Responsibilities

Clients are responsible for providing accurate and timely information reasonably necessary to complete their project.

Clients are also responsible for reviewing information, materials, and project content supplied by them or approved for publication and for ensuring they have the rights, licenses, permissions, or authority necessary to use any logos, photographs, videos, trademarks, text, product information, customer information, or other materials they provide.

Delays in providing required information, access, approvals, feedback, or materials may affect project timelines.

Content and Materials

Custom website or advertising content may be developed as part of an agreed service.

Clients are responsible for reviewing and approving factual information about their business, including services, products, pricing, guarantees, certifications, licenses, locations, policies, contact information, claims, and other business-specific statements before or after publication as applicable to the project workflow.

I may rely on information provided by the client when developing project content.

Revisions and Changes

Revisions, modifications, and changes are handled according to the scope established for the applicable project.

Requests that materially change the original direction, structure, content requirements, number of deliverables, functionality, or agreed scope may be treated as additional work and may require additional fees or a new proposal.

Project Timelines

Any estimated project timeline depends on the scope of work, client responsiveness, availability of materials, revisions, approvals, third-party services, and other project requirements.

Unless expressly guaranteed in a written agreement, estimated timelines are planning estimates and may change when circumstances affecting the project change.

Fees and Payments

Prices displayed on the Website may be starting prices, base service prices, recurring fees, or specific add-on prices.

The final amount applicable to a project depends on the services and scope agreed upon.

Payment schedules, deposits, balances, recurring fees, accepted payment methods, refunds, and other financial terms may be specified in the applicable proposal, contract, invoice, or written project agreement.

Clients are responsible for third-party costs identified as their responsibility, including advertising budgets and recurring services transferred to or managed directly by them.

Intellectual Property and Ownership

Ownership and usage rights for completed project deliverables depend on the service purchased and any applicable project-specific agreement.

Clients retain ownership of materials they provide and represent that they have sufficient rights to authorize their use in the project.

Third-party software, platforms, fonts, stock assets, applications, templates, plugins, or other licensed materials remain subject to the rights and licenses of their respective owners and are not transferred beyond what those licenses permit.

Full Ownership of a website does not transfer ownership of third-party technologies or intellectual property that the client or I do not own.

Portfolio and Project Display

Unless restricted by a written agreement, completed work and publicly available portions of a project may be referenced or displayed as examples of professional work, including within my portfolio, case studies, website, presentations, or professional marketing materials.

Confidential information, passwords, private account data, unpublished business information, and other information reasonably understood to be confidential will not intentionally be displayed as portfolio material.

A client may contact me to discuss legitimate confidentiality concerns relating to the display of a project.

Website Availability and Information

I make reasonable efforts to keep the Website available and its information current, but uninterrupted availability, error-free operation, or permanent availability of any particular content or feature is not guaranteed.

Website information, service descriptions, pricing, packages, features, and these Terms may be updated as the business and services evolve.

A change to Website pricing does not retroactively modify the price of a project already governed by an existing written agreement unless that agreement provides otherwise.

No Professional Legal, Financial, or Tax Advice

Information provided on this Website relates to my digital services and general business communication. Nothing on the Website constitutes legal, financial, accounting, tax, or other regulated professional advice.

Clients should consult appropriately qualified professionals when such advice is required for their business.

Limitation of Liability

To the extent permitted by applicable law, I will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the Website or services, including lost profits, lost revenue, lost business opportunities, loss of data, or outcomes dependent on third-party platforms or circumstances outside my reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Any additional limitations applicable to a particular project may be established in the corresponding written agreement.

Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, or expenses arising from materials or information you provide without the necessary rights or permissions, your unlawful use of the Website or services, or your violation of applicable law or these Terms.

Any project-specific indemnification obligations may be further defined in a written agreement.

Termination or Suspension of Services

Services may be suspended or terminated in accordance with the applicable project agreement, including circumstances involving nonpayment, material breach of agreed terms, unlawful activity, misuse of services, or failure to provide information or cooperation reasonably necessary to continue the project.

The consequences of termination, including outstanding balances, access, ownership, recurring services, or delivery of completed work, may depend on the applicable project agreement.

Privacy

Use of personal information associated with the Website is also governed by the Privacy Policy, which should be read together with these Terms.

Changes to These Terms

These Terms may be updated periodically to reflect changes in services, business practices, technologies, or legal requirements.

The “Last Updated” date may be revised when changes are made. Continued use of the Website after updated Terms become effective constitutes acknowledgment of the revised Terms to the extent permitted by applicable law.

Governing Law and Disputes

The laws and dispute-resolution procedures applicable to a specific paid project may be established in the contract or written agreement governing that project.

For matters relating solely to use of the Website where no separate agreement applies, applicable law and jurisdiction will be determined according to relevant legal requirements.
